These Terms of Use (“Terms”) set forth the legally binding terms and conditions governing access to, and use of, the website located at www.emeded.org (the “Website”). The Website is owned and operated by eMedEd, Inc., a non-profit organization organized under the laws of the United States (“eMedEd,” “we,” “us,” or “our”).
By accessing, browsing, registering for, or otherwise using the Website, you acknowledge that you have read and understood these Terms, and you agree to be bound by them, as well as by the eMedEd Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Website.
- 1. Purpose of the Website
The Website is designed to support the mission of eMedEd by providing high-quality continuing medical education (CME) and continuing education (CE) activities for healthcare professionals. Educational activities may be developed and delivered directly by eMedEd or offered through joint providership arrangements with eligible partner organizations. All educational content is intended solely for professional education. Nothing on the Website is intended to substitute for independent clinical judgment, professional decision-making, or individualized patient care. - 2. Eligibility and Account Responsibilities
Use of the Website is limited to individuals who are at least eighteen (18) years of age and who are legally capable of entering into binding agreements. When registering for an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. eMedEd reserves the right to suspend or terminate accounts where inaccurate information is provided or misuse is identified. - 3. Educational Activities, Credit, and Certificates
Participation in educational activities may be subject to eligibility requirements and completion criteria, which are disclosed for each activity. CME or CE credit is awarded only after all required components—such as attendance, assessments, evaluations, and attestations—have been satisfactorily completed. The acceptance of CME or CE credit is determined by licensing boards, certification bodies, employers, or other authorities. eMedEd does not represent or guarantee that completion of any activity will meet specific professional requirements. - 4. Independence, Data Integrity, and ACCME Firewall
eMedEd maintains full and independent control over the planning, development, delivery, and evaluation of all accredited educational activities. Decisions regarding educational content, learning objectives, faculty selection, instructional methods, and outcomes measurement are made exclusively by eMedEd or its designated planning committees. No commercial interest or entity deemed ineligible under the Accreditation Council for Continuing Medical Education (ACCME) Standards for Integrity and Independence is permitted to influence educational content or outcomes. Learner information, including registration and participation data, is not shared with commercial interests unless the learner provides explicit, affirmative consent at the time such information is collected. These practices are designed to preserve the independence, credibility, and educational integrity of all activities. - 5. Intellectual Property Rights
All materials available through the Website, including text, graphics, videos, audio recordings, assessments, and course materials, are the property of eMedEd or its licensors and are protected by applicable intellectual property laws. Users are granted a limited, non-exclusive, revocable license to access and use Website content solely for personal, non-commercial educational purposes. Any other use requires prior written authorization from eMedEd. - 6. Acceptable Use
You agree not to misuse the Website, including but not limited to misrepresenting professional credentials, sharing account access, attempting unauthorized system access, or using the Website for marketing or solicitation purposes. - 7. Fees, Payments, and Refunds
Certain activities may require payment of fees, which are disclosed at the time of registration. Payments are processed through secure third-party payment providers. Refund eligibility, if any, is governed by the specific refund policy applicable to the activity. - 8. Privacy and Data Protection
Your use of the Website is subject to the eMedEd Privacy Policy. Personal information is collected and processed for educational administration, accreditation compliance, and related operational purposes. - 9. Joint Providership
For activities offered through joint providership, eMedEd retains responsibility for compliance with applicable accreditation standards. The roles and responsibilities of joint providers are defined through written agreements. - 10. Disclaimers
The Website and its content are provided on an “as is” basis for educational purposes only and do not constitute medical, legal, or professional advice. - 11. Limitation of Liability
To the fullest extent permitted by law, eMedEd shall not be liable for indirect, incidental, or consequential damages arising from your use of the Website. - 12. Governing Law and Jurisdiction
The laws of the State of New Jersey govern these Terms. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located within New Jersey. - 13. Contact Information
